If we cannot resolve the dispute informally within 30 days, you and MoMoney agree that any dispute arising out of or relating to these Terms or the Website will be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association ("AAA"), except as modified by these Terms.

The arbitration will be conducted in Dallas, Texas, unless you and MoMoney agree otherwise. Each party will be responsible for paying any AAA filing, administrative, and arbitrator fees in accordance with AAA rules.

12.3 Exceptions to Arbitration

Either party may bring a lawsuit in court solely for injunctive relief to stop unauthorized use or abuse of the Website or infringement of intellectual property rights without first engaging in arbitration.

12.4 Class Action Waiver

YOU AND MOMONEY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
